These Terms of Use ("Terms") govern your access to and use of AfterDiary, including our website, mobile applications, desktop applications, and related services (collectively, the "Service"). The Service is provided by AfterDiary ("we," "us," "our").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and these Terms apply to that organization.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under the age of majority where you live, you may only use the Service with consent of a parent or legal guardian.
The Service is not designed for children under 13.
We may update these Terms from time to time. If changes are material, we will take commercially reasonable steps to notify you (for example, via email or in-app notice). Continued use of the Service after changes become effective means you accept the updated Terms.
We may modify or discontinue the Service (or any part of it) at any time. We'll try to give advance notice when practical, but we're not obligated to do so.
To access certain features, you must create an account.

You are responsible for all activities that occur under your account. We are not responsible for losses caused by unauthorized access to your account, but you may be liable for our losses caused by your failure to secure your account.
"Content" means information you upload, create, import, store, or send through the Service, including contacts, notes, and interaction history.
You retain ownership of your Content.
You grant us a limited, worldwide, non-exclusive license to host, process, transmit, and display your Content solely to provide, maintain, and improve the Service, including providing customer support and preventing abuse.
This license ends when you delete your Content or account, except:
If you connect third-party services (email, calendar, messaging, social), you authorize us to access data from those services as described in the Privacy Policy and in the connection flow. You are responsible for complying with the third-party provider's terms.
You agree not to misuse the Service. You will not, and will not attempt to:
Break the law
Use the Service in violation of any applicable law, regulation, or court order.
Abuse or harm others
Harass, threaten, defame, or invade the privacy of others.
Upload harmful content
Upload or transmit malware, exploits, or anything that interferes with the Service.
Interfere with systems or security
Probe, scan, or test vulnerabilities, or bypass access controls.
Reverse engineer
Reverse engineer, decompile, or attempt to extract source code (except where allowed by law).
Scrape or automate unauthorized access
Use bots, crawlers, scrapers, or automated means to access the Service or extract data without our written permission.
Resell or misuse the Service
Rent, lease, resell, or provide the Service to others unless explicitly permitted by a written agreement with us.
We may investigate violations and take action, including removing Content, limiting functionality, suspending accounts, or reporting to authorities where appropriate.
If the Service includes AI-assisted features:
The Service may integrate with or display content from third parties. Third parties have their own terms and privacy policies, and we are not responsible for third-party services, content, or availability.
Your use of third-party services is at your own risk.
If you purchase a subscription, you agree to pay the fees shown at checkout. Subscriptions auto-renew unless canceled in accordance with the plan and provider rules.
Trials may convert to paid subscriptions at the end of the trial period unless canceled before the conversion date.
We may modify or discontinue trials at any time.
Payments may be processed by third parties (e.g., Stripe, Apple App Store, Google Play). Your billing relationship may be with the platform you purchased through.
You can cancel at any time. Cancellation takes effect at the end of the current billing period unless otherwise required by law.
Except where required by law (including certain consumer protections), payments are non-refundable and we do not provide credits for partial periods or unused time.
If you purchased through an app store, refunds (if any) are governed by the store's policies.
We may suspend or terminate your account immediately if:
You may stop using the Service and delete your account at any time.
Upon termination, your right to use the Service ends. Some provisions of these Terms survive termination (see Section 17).
The Service, including its software, design, and branding, is owned by us and protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business use (depending on your plan) in accordance with these Terms.
You may not use our trademarks without our prior written permission.
If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation, including to improve the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that:

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold harmless AfterDiary and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of:
Governing Law: These Terms are governed by the laws of Delaware, excluding conflict-of-law rules.
Venue: Any dispute will be brought in the state or federal courts located in Delaware, unless otherwise required by applicable law.
You may not use the Service if you are located in a country subject to embargoes or if you are on a restricted persons list under applicable export control or sanctions laws.
The following sections survive termination: 4 (Your Content and License), 10 (IP), 11 (Feedback), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), 15 (Disputes), 16 (Export), 17 (Survival).
Entire Agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
Severability: If a provision is unenforceable, the remaining provisions remain in effect.
No Waiver: Failure to enforce a provision is not a waiver.
Assignment: You may not assign these Terms without our consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
Notices: We may provide notices via email, in-app messages, or the website.
